In the framework of one of its monitoring projects Creative Union "Technologeis of Optimum Personality Development" several times addresed Kirovohrad mayor and secretary of Kirovohrad City Council during February 2008 with the request to provide information as for activity of city council and its executive organs. The authorities reacted on the TORO addresses, but the response for one of the information queries of the organization can become the beginning of the new legend about interaction of the authorities and community of Kirovohrad.
In its letter №31 from the 6th of Febraury, 2008 TORO decided to express their interest in organizational structure of town executive organ, the surnames, names and patronymics, contact addresses and telephone numbers of the heads of departments, the list of sectors or other units, which belong to structural departments of executive committee. EACH NGO of Ukraine has the right to get this information in conformance with article 34 of the Constitution of Ukraine and articles 9,10, 28, 29, 32, 33, 45 of the Law of Ukraine "On information". Moreover, the legislation presupposes disciplinary, civil, administrative or criminal liability for keeping such kind of information by the authority organ.
In its reply, dated 14th of February 2008, Kirovohrad mayor Volodymyr Puzakov pointed out, that in compliance with article 37 of the law of Ukraine "On information", official documents, which have confidential information, relating to personal life of citizens, documents, which are the part of inner correspondence, if they relate to the development of institution activity, decision-making process are not subject to obligatory submission for review based on the information request. Therefore, the mayor rejected giving out the information.
Considering the ambiguity of the reply of the mayor, TORO initiated the meeting with the mayor, which took place on the 6th of March, with the TORO President "Oleksiy Khmara, Kirovohrad mayor Volodymyr Puzakov and head of the legal department of Kirovohrad city council Ihor Nikitchuk. During the meeting, Oleksiy Khmara asked for the reasons of such a reply by the city mayor, but got a brutal answer that NGO should be satisfied with the answer it had already got and should address the mayor with such inquiries any more.
It was decided to proceed with this discussion in the court hearing, to find out, whether the community has the right to know contact information of the people, who govern it.
