Verhovna Rada decided to fine for giving bribes

Verhovna Rada adopted the law "On responsibility of legal persons for committing corruption delinquencies". The law was adopted in conformance with the UN Convention against corruption and Criminal Convention on corruption fight.

The operation of a law doesn't cover legal persons of public law, which are completely supported by state or local budgets, as well as international organizations.

The law presupposes that the court can impose the following kinds of punishments on the legal persons: fine; ban of certain activity, deprivation of property, and dissolution of a legal person.

According to the law, offering a bribe to the official of the state authority or local authority leads to imposition of a fine on a legal person in the amount from 300 to 1000 of the exemption limit.

Giving bribe to the official of the state authority or local authority leads to imposition of a fine on a legal person in the amount from 1000 to 5000 of the exemption limit.

Second giving of the bribe to the official of the state institution leads to imposition of a fine on a legal person in the amount from 5000 to 10000 of the exemption limit with the ban of up to 1 year to conduct certain activity, in relation to which the bribe was given.

Giving bribe either of a big amount, or if it led to taking illegal decision or adopting legal act, leads to imposition of a fine on a legal person in the amount from 7000 to 15000 of the exemption limit with the ban of up to 3 years to conduct certain activity, in relation to which the bribe was given, or the dissolution of the legal entity.

Illegal granting of material welfare to the person who is an official of the state or local authority, but performs public powers given by law (auditor, notary, expert, evaluator, lawyer, arbitrary head, independent mediator or the member of the working arbitrary organ while considering collective industrial disputes) leads to imposition of a fine on a legal person in the amount from 3000 to 7000 exemption limits.

Similar actions, performed for a second time or in a big amount, lead to imposition of a fine on a legal person in the amount from 5000 to 10000 exemption limits with a ban to conduct certain activity, in relation to which there was illegal granting of material welfare, up to 1 year.

Based on the results of the research of international organization Transparency International in 1997-2007 the index of corruption perception in Ukraine remains almost unchanged - within 2,1 - 2,8 points. In 2007 Ukraine got 118 place (2,7 points) from 179 states concerned
