HOW DID THE GOVERNMENTALLY AUTHORIZED PERSON IN
ANTICORRUPTION DISPLEASE THE PRESIDENT OF UKRAINE?

 

During the first seating of the National Anticorruption Committee Viktor Yanukovich offered the Prime-Minister of Ukraine to initiate the change of the Governmentally Authorized Person in Anticorruption Policy. The President sees Minister of Justice O.Lavrinovich as a coordinator of state anticorruption policy. The community supposes this step to be the beginning of the end of existence of the institution of the Governmentally Authorized Person.

During the first seating of the National Anticorruption Committee while discussing the present stage of corruption risks and problems, Viktor Yanukovich drew attention at the necessity of activization of work in the area of corruption counteraction in Ukraine. Starting his speech, the President pointed out that the single anticorruption organ should be created in Ukraine. It should be engaged in forming and realization of the whole anticorruption policy. Today, until the functions and format of work of such institution are defined, National Anticorruption Committee within the President of Ukraine should become the place of forming anticorruption policy in the opinion of V.Yanukovich. The work of the latter presupposes creation of topical working groups within the Committee, working out certain strategies and draft laws with the participation of national and international specialists, involving the community in the work of the Committee.

But the address of Viktor Yanukovich to the Prime Minister of Ukraine with the suggestion to replace the Governmentally Authorized Person in Anticorruption Policy with the candidature of the Minister of Justice Oleksandr Lavrynovych became quite a sensation of the first seating of the National Anticorruption Committee. The President actually insisted on the idea that Mr. Lavrinovich as an Executive Secretary of the National Anticorruption Committee is a more worthy candidature for the position of the Governmentally Authorized Person rather than the current Head of the Department.

This decision of the President of Ukraine got negative evaluation from separate members of the National Anticorruption Committee. While commenting the instruction of the President as for initiating the change of the Governmentally Authorized Person, Oleksii Khmara, President of Creative Union “TORO” - Transparency International Contact group in Ukraine stated the following: “By its nature the Governmentally Authorized Person should be an independent institution, which can transfer to the Government of Ukraine the information about corruption accidents and problems, which occur at all the vertical of executive authorities in Ukraine, in an unbiased way. Therefore, any Minister without exception simply cannot combine his/her activity with the functions of the Governmentally Authorized Person. It should be a certain independent person with the independent functions and authorities. If to speak personally about Minister of Justice, it will be especially difficult for him to combine the obligations of the Minister, the Executive Secretary of the National Anticorruption Committee and the Governmentally Authorized Person. From such a combination one of the designated functions can be weakened”.

Let us remind that after the selection of Viktor Yanukovich as a President of Ukraine the majority of key state institutions in all the authority spheres is in the hands of representatives of one political environment – ruling coalition of the Party of Regions with the Communists and Litvin block. Heads of law enforcing and judicial organs are actually loyal to the Administration of the President. For sure, such homogeneousness of views of the team in power will contribute to the fast establishing of order in the country. But one can carefully speak about the effectiveness of mutual control and legal pressure mechanisms in such situation.
