The overall effectiveness of the local administrations in the Kirovohrad region to implement the Concept of promoting the civil society development by the executive authorities does not exceed on the regional level 65% and on the district level 25%. At the same time, 3 of the 9 district state administrations which were submitted to the expertise, in actual fact did not even take part in the implementation of the Concept.
Due to the coalition of the non-governmental organizations and civil activists of the Kirovohrad region, there has been conducted a civic expertise on the implementation of the Concept promoting civil society development by the executive institutions in 2009 (hereafter Concept). During April-July 2010, civic experts assessed the state of Concept implementation, in particular the conduction of public consultations and participation of civil society in controlling Kirovohrad’s regional and district state administrations.
Based on the results of the expertise, it was identified that a majority of local administrations consider their activity in implementing the Concept trough communication with civil society (65% of measures on the regional level and 75% on the district level) as well as trough forming of civic culture (5% of measures on the regional and 15% on the regional level). Thereby, the overall effectiveness of the local administrations to implement the Concept does not exceed on the regional level 65% and on the district level 25%.
The practice of the local state administrations of the Kirovohrad region to form their own policy in implementing the Concept of promoting the civil society is at a low level. An action plan for the Concept realization is absent in every third state administration. For example, Kirovohrad district state administration followed the plan of the Kirovohrad regional state administration. This was the only one action plan in the region focused on the Concept implementation. At the same time, reporting on the already implemented Concept by the local state administrations is mostly formal. The reports concerning the implementation of the Concept at the regional/district level were realized only in 3 of the 10 examined administrations, however one report did not even consist analytical elements.
A common use is also within the framework of the Concept of promoting the civil society development by the local authorities to implement actions which are not related to the Concept or do not impact of the content quality of the Concept.
So, most of the action plans adopted by the local authorities have an informative nature withou truly involving of the civil society. The community councils work generally in the same composition as 3-5 years ago without being considerably renewed. Significant is the fact that community council at Kirovohrad regional state administration having the lowest number of representatives at the Institute of civil society council, was renewed most rarely among the others community councils in the region. Almost every forth member of the community council at the district level is a public official whereas at the regional level it is every sixth.
By analyzing the work of local state administrations, the experts learned in detail the practice of conducting consultations with the civil society. In spite of the fact that among the 10 examined local state administrations only 6 did submit their consulting plans with civil society, the experts identified that:
- Not even one of the analyzed executive bodies did conduct a consultation with civil society according completely to the requirements of the CMU Decree Nr. 1378 from the 15th of October 2004;
- Direct forms of consultation with the civil society (personal meetings, public hearing) are only used by the Kirovohrad regional state administration as well as by the Svetlovodsk district state administration;
- Consultations by using the website are more often used by the Kirovohrad regional state administration as well as by the Svetlovodsk district state administration;
- In the consultation process with civil society is involved every third department of the local state administration;
- Only Kirovohrad regional state administration as well as the Kirovohrad district state administration have criteria to ensure the representativeness of the concerned groups;
- Local state administrations themselves act mostly, community council sometimes and never civil society as initiators of the consultations with the civil society;
- Public opinion study as a form of consultation with the civil society is practiced by the Kirovohrad regional state administration, Onufrievka and Petrovo district state administrations;
- A detailed information about the submitted and taken into account recommendations based on the results of the consultations were only submitted by the Kirovohrad regional state administration, Onufrievka and Petrovo district state administrations;
- The consultations with the authorities are mostly considered by the local administrations as the voice of their own positions without taking into account the position of the civil society;
- In fact no one of the examined executive bodies did not point at the existence of the protocols recording the results of the consultations with the civil society.
In addition, the experts did not only identify the problematic issues but also develop detailed recommendations which can improve public policy in this direction.
